By installing, configuring, or connecting to NocturneVPN, you agree to this service covenant. We provide open-source cryptographic privacy tools under GPL-2.0, paired with explicit acceptable use obligations and fair-play boundaries.
The Service Scope & Purpose
NocturneVPN is an open-source (GPL-2.0) native Android VPN client engineered to encrypt mobile packet streams, bypass censorship firewalls, and guard personal privacy across public Wi-Fi networks and untrusted telecommunications infrastructure.
The service operates a hybrid routing mesh consisting of decentralized volunteer academic relays through the VPN Gate Project and high-performance 10Gbps RAM-only VIP Dedicated clusters maintained directly for subscribers and Reward Hub coin holders. The client software and servers are provided for legitimate personal security and data defense.

End-to-end cryptographic shielding against ISP snooping, man-in-the-middle attacks, and rogue hotspots.
Dual Protocol Core
Flexible UDP (maximum gaming/streaming throughput) and TCP (censorship and hotel Wi-Fi traversal).
Acceptable Use Policy & Prohibitions
Privacy is a human right, but weaponizing privacy infrastructure against others is strictly prohibited. You agree that you will NOT utilize NocturneVPN, its servers, or client protocols to:
Unlawful Activity & Cyberattacks
Engage in any activity that violates local or international law, including transmitting malware, trojans, ransomware, automated port scans, or Distributed Denial of Service (DDoS) attacks.
Spam, Phishing & Fraud
Broadcast unsolicited bulk emails (spam), host deceptive credential-harvesting phishing portals, or orchestrate financial fraud.
Mesh Abuse & Resource Degradation
Abuse or saturate volunteer VPN Gate relay nodes through automated scraping or peer-to-peer torrent bandwidth hoarding that degrades connectivity for other users.
Subscriptions, Google Play Billing & Economy
All premium subscriptions and sovereignty tier upgrades are handled exclusively through the official Google Play Billing system:
No Card Data Handled
NocturneVPN never collects, stores, or sees your credit card, debit card, or bank credentials. All transactions are securely mediated by Google.
Cancel Anytime
You may cancel subscriptions at any moment via Google Play > Profile Icon > Payments & Subscriptions > Subscriptions. Access continues until period end.
Reward Hub Virtual Coins
Coins and passes unlocked via the in-app Reward Hub possess zero monetary cash value, cannot be redeemed for legal tender, and are non-transferable.
Academic VPN Gate Relay Mesh Disclaimer
Free relay clusters in NocturneVPN connect to the VPN Gate Academic Experiment, hosted by volunteer researchers and individuals worldwide under the University of Tsukuba:
NocturneVPN does not own, configure, or control individual third-party VPN Gate volunteer nodes. While OpenVPN packet encryption prevents local network sniffing, we cannot warrant the ongoing speed, uptime, or conduct of individual academic volunteer hosts.
For sensitive workflows, commercial banking, or mission-critical privacy, users should connect to Nocturne Dedicated VIP clusters, which are isolated from volunteer networks and operated under verified zero-log bare-metal RAM architecture.
Open Source Licensing (GNU GPL-2.0)
The NocturneVPN Android application is free, copyleft software licensed under the GNU General Public License v2.0 (GPL-2.0). You are granted full statutory rights to inspect, audit, fork, modify, and redistribute the software in accordance with the terms of the GPL-2.0 license.
Nothing in this Terms of Service document modifies, restricts, or limits any rights granted to you under the GNU GPL-2.0 license regarding the software source code itself.

Warranty Disclaimer & Limitation of Liability
To the maximum extent permitted under applicable law, the NocturneVPN software and network services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.
In no event shall NocturneVPN, Ventrox Tech, or developer Mitul Chovatiya be held liable for any indirect, incidental, punitive, consequential, or special damages (including loss of data, business disruption, or third-party volunteer relay conduct).
Our aggregate liability arising out of or related to the service shall in no event exceed the total amount actually paid by you through Google Play Billing during the twelve (12) months immediately preceding the event giving rise to the claim.
Amendments, Governance & Contact
These Terms of Service may be updated as the application evolves, new VPN protocol ciphers are integrated, or legal frameworks update. Material changes will be clearly documented in official GitHub release commits and application updates.
